An easement by agreement is one negotiated by the parties. An easement by necessity is created where one parcel of land is land locked or has no access to a public road. An easement by prescription is an easement created when a person without right or authorization uses or occupies the land of another for a statutorily prescribed period of time.

Answer to Question 2

A stop and frisk, or Terry, search is a pat-down search conducted during an officer's investigatory detention of an individual. The primary purpose of this search is to ensure the officer's safety allowing the officer to search a person's outer clothing for weapons.
