Local governments seek to control development of the land within their boundaries through zoning codes. Building codes are adopted in order to have buildings erected with certain safety concerns addressed. Both of these limit the free use of the property.

Fee simple ownership is subject to federal statutes and regulations such as (1)The Fair Housing Act of 1968 which eliminated discrimination in the sale of real estate (2) The Community Reinvestment Act of 1977 which eliminated discrimination in real estate lending, (3) The Clean Air Act of 1970 and Clean Water Act of 1972 were designed to control the discharge of pollutants into the air and water. The actions of agencies such as the Environmental Protection Agency can also impact the rights and obligations of homeowners.
