Negotiated rulemaking refers to the process of using a committee of interested parties and
those affected by a new law to negotiate the rules and regulations designed to implement the
new law. When a rule is proposed, the head of the agency that will enforce the law will
publish its intention to establish a committee for rulemaking. Interested people can apply to
be on the committee. A facilitator will be selected who will impartially assist the members in
conducting negotiations and discussions in order to draft a rule that is both effective and will
have the broadest base of support possible.
