What provisions exist for discovery of information that cannot be delivered in paper or electronic form? Describe at least three situations where discovery rules allow discovery that is not in the form of documents.

Answer to Question 1

Student responses may vary depending on the situations chosen by the students, but answers may include depositions, which are in-person interviews of parties or witnesses under oath, or requests for production of documents and things, which may allow a party to enter a building or vehicle to inspect its contents.

Answer to Question 2

Everything is discoverable that is not privileged and is relevant or may lead to evidence relevant to the lawsuit. This is much broader than what is admissible under the rules of evidence at trial.
