If the plaintiff fails to serve a complaint within 120 days (federal), it will automatically be dismissed with prejudice, never to be brought again.

A void contract cannot be enforced at all. A voidable contract can be voided by the injured party or person lacking capacity, but that party can also choose to enforce it.
