Answer to Question 1

Privilege review is the process of reviewing a client's documents to identify those that contain privileged or confidential information, or attorney work product. Even with a careful privilege review, documents that are considered privileged may still be overlooked and produced unintentionally, which is referred to as inadvertent disclosure.

Answer to Question 2

Paper documents are converted to electronic form by scanning them and converting them to a PDF or TIFF. Electronic documents are more easily transferred or sent, can be easily searched for relevant information using search software, and eliminate the cost of photocopying. They are also more easily scanned and redacted during a privilege review.
