Does metadata always need to be produced with a document? How do courts view the production of metadata?

If the requesting party does not specify a format for production of the documents, what form may the producing party use? What rules govern the format for production?

Answer to Question 1

Some courts have rules that it is not always necessary that metadata be produced with a document. A format other than a document's native format may be considered to be a usable format, and will therefore be allowed.

Answer to Question 2

Rule 34 says that if no format is specified, the responding party can produce them in whatever format they were kept in the usual course of business, or a reasonably usable form.
