First, a nominee is selected by the president. A president's nomination is sent to the Senate for consentthat is, the Senate may either deny or confirm the nomination. A simple majority is required for senatorial confirmation.

The Supreme Court sits at the apex of the federal judiciary. This court was created directly by the Constitution. Under the Supreme Court are the United States Courts of Appeals. There are thirteen Courts of Appeals. These courts were created by Congress. Under the Courts of Appeals are the United States district courts. There is at least one district court in each state and there are more in larger states. These courts were created by Congress. Under the district courts are bankruptcy courts and magistrate-judges. In addition, Congress has created several specialty courts.
