Phil is developing a large parcel of land on which to build new homes. The zoning code requires all homes to be set back 90 feet from the centerline of the street. Phil wants to build the homes with a setback of 80 feet. What should Phil probably do?
 
  A. Apply to the city for a variance
   B. Sue the city for an unconstitutional taking
   C. Build the homes with the setback of 80 feet because he owns the land in fee simple
