The measuring life can be that of grantor, the life tenant, or another individual. The life estate is frequently used a method of planning and control over the distribution of the real estate, including protecting the real estate from creditors and providing housing for a financially irresponsible or physically disabled child.

The key analysis relates to how the item is attached and whether its removal will result in significant harm to the property. As part of that analysis several factors should be considered: the means and method of attachment; the adaptation of the object outside the real property; the intent of the party who originally attached the object;
the relationship of the parties, and; the existence of an agreement that defines whether the object is part of the real property.
