Answer to Question 2

In United States v. Booker the Court held that the federal sentencing guidelines are unconstitutional but judges may use them as advisory information. In later cases, the Court held that judges may sentence defendants more leniently than the guidelines prescribe, particularly in crack cocaine cases (Kimbrough v. United States, 2007).
