Answer to Question 1

Payment to court-appointed counsel is dramatically lower than payment to privately-retained attorneys. In many instances, payments to court-appointed counsel are capped at a specific dollar amount despite the amount of work that a given attorney may put into a case. This type of work often attracts lawyers who either firmly believe in the Constitutional rights of all defendants, no matter the crime alleged, or, more often, lawyers who cannot succeed in private practice and/or those who many not have been at the top of their class in law school.
