Bail represents money or some other security provided to the court to ensure the appearance of the defendant at trial. The right to bail comes from the Eighth Amendment of the Constitution; it is meant to ensure that the defendant appears at trial. Bail penalizes the indigent offender who does not have the means to pay the bond; failing to make bail appears to increase both the risk of being convicted and the degree of punishment received
