A waiver is an intentional giving up of a known right or remedy. Rights under Miranda may be waived, but the burden is on the government to prove proper waiver of rights. Explain what is required for a proper waiver of rights and why. Give an example.

For a proper waiver of rights under Miranda, the government must prove that the
defendant knowingly and intelligently waived his privilege against self-incrimination
and his right to retained or appointed counsel. This requirement on the prosecution is
to make the government prove the defendant has given up these significant rights
without coercion. An example is when the prosecution shows a video recording of
the defendant being read his rights and answering questions about his rights, then
consenting to waive those rights.
