When a traffic stop becomes more than a routine traffic stop for roadside
questioning, it becomes necessary for an officer to read a person their Miranda
rights, because it now has become a custodial interrogation. For example, an officer
stops a vehicle for speeding. When approaching the driver's window, the officer
smells the odor of burning marijuana. Questioning now focuses on the non-traffic
crime of possession of controlled substance.
