Answer to Question 1

The five considerations justifying the automobile exception as stated in Robbins v.
California are: (1) The mobility of motor vehicles often makes obtaining a judicial
warrant impractical. (2) A diminished expectation of privacy surrounds the
automobile. (3) A car is used for transportation, not as a residence or a repository of
personal effects. (4) The car's occupants and contents travel in plain view. (5)
Automobiles are necessarily highly regulated by the government.

Answer to Question 2

At the time of the decision, Prohibition was the law, and individuals were prohibited
from possessing alcoholic beverages. Today, individuals are prohibited from
possessing controlled substances. The same constitutional principles apply in that
vehicles are searched for contraband.
