Answer to Question 1

Answer: When seeking a search warrant regarding criminal activity, the investigator must prove they have established probable cause. A probable cause statement must be clearly written with the specific information and details of the grounds for a probable cause, signed by the officer and presented for the judge to review. If the judge agrees, then they will sign the probable cause statement. A warrant affidavit must be authorized by the proper official, issued for specific items, and based on probable cause. The warrant affidavit must be prepared before obtaining the warrant. The warrant must contain the reasons for the search name of the officer requesting the warrant, items to be seized, specific place to be searched, and the signature of the issuing judge. After the warrant has been issued, it should be executed promptly.

Answer to Question 2

Answer: Interference with the suspect's freedom of movement, confrontation involving several officers which leads to an atmosphere of intimidation or displaying weapons, any physical contact with the suspect, or retaining personal property of the suspect will all violate the concept of a consensual encounter and field interview.
