Answer to Question 1

Answer: The color of law occurs when an individual acts in an official government capacity and with the appearance of legal power. This includes police officers, mayors, and a number of other government officials. Examples would include at least three of the following: a police officer on duty, identifying him- or herself as a police officer, performing criminal investigations, filing official police documents, making arrests, invoking police powers inside or outside his or her jurisdiction, settling personal vendettas with police power, or displaying weapons or police equipment.

Answer to Question 2

Answer: To reduce the temptation for internal investigators to proceed against police employees in an insensitive fashion, some police agencies have formally adopted a statement of the rights of police officers who are accused of misconduct. The typical police officers' bill of rights requires advance notice to an officer who is being investigated, spells out procedures for resolving complaints that maintain due-process protections, and limits the lengths to which an agency can go to secure information through interrogation and investigations.
