Answer: Miranda defined interrogation as questioning initiated by law enforcement officers. The Court determined that interrogation must reflect a measure of compulsion above and beyond that inherent in custody itself. Thus, any questions that tend to incriminate, such as those that are directed toward an individual about his or her suspected involvement in a crime, are considered interrogation.

Answer: The Fourth Amendment is an amendment to the U.S. Constitution that governs search and seizure. It applies when a search or seizure is being contemplated or takes place. Two important elements must be considered; whether the search is a product of government action, and whether the government action infringes upon the individual's reasonable expectation of privacy.
