Intentional wrongs are situations in which the officer intended to engage in the conduct that led to an injury. These cases typically involve situations in which an officer engaged in conduct that was substantially certain to cause harm. Examples include the excessive use of force, false arrest and imprisonment, assault and battery, wrongful death, intentional infliction of emotional or mental distress, misuse of legal procedure, invasion of privacy, illegal electronic surveillance, defamation, and malicious prosecution.
The breach of a common law or statutory duty to act reasonably toward those who may be harmed by an officer's conduct are liable to be tried in a civil court as negligent wrongs. Examples of possible negligent wrongs include negligent operation of a motor vehicle, negligent failure to protect an individual or personal property, and negligent failure to respond to calls.
