Answer to Question 1

Answer: A good answer will list and explain the three elements that will satisfy the requirements. Students should also describe the landmark cases associated with the elements mentioned in the text.

Answer to Question 2

Answer: Good answers will explain which party benefits the most and least by describing specifically what makes that party benefit the most/least. Students should list what specific benefits are gained. Their position should be supported by using the courts reasoning in deciding cases or making a strong case against the courts decision. This question is also partially opinion based.
