Answer to Question 1

Answer: Good answers should define double jeopardy and explain the circumstances in which it arises
re-prosecution after acquittal, re-prosecution after conviction, and separately punished for the same conduct. Students should explain the Blockburger rule on the separate offense issue. Finally, students should also address when the right does not apply  new circumstances (e.g., the death of an assault victim), defense caused mistrials, and court initiated plea -bargained dismissal of charges over the prosecutions objections.
