Speedy Trial - The Sixth Amendment provides, in part, In all criminal prosecutions,
the accused shall enjoy the right to a speedy trial. The federal Speedy Trial Act (18 U.S.C. Sections 31613174) plus statutes in every state also set forth a right to a speedy trial. the
Court identified three advantages associated with having a speedy trial:

 It prevents excessive incarceration.
 It minimizes the anxiety experienced by the accused as a result of a publicized accusation.
 It prevents damage to the defendant's case resulting from too much delay.

Answer to Question 2

It is a defense in the criminal law sense, but it is one of the only defenses that calls into question law enforcement's role in the instigation of a crime. Hence, it is almost always brought up in the realm of criminal procedure.
