Answer: They could be a number of reasons why. In the case of Pacileo v. Walker, the governor of California signed
the extradition papers, but the California Supreme Court ordered a local court to investigate the
conditions of the Arkansas prison system to determine whether they violated the Cruel and Unusual
Punishment Clause of the Eighth Amendment to the U.S. Constitution.

unlawfully detained. This writ may be issued by a trial court of general jurisdiction or by an appellate
court.
