Answer: Under Roman law, imprisonment was illegal. Under English law, imprisonment became a means of
holding an accused person for trial, but not for punishment. Banishment from the country was also
widely used. Today, imprisonment has become more the norm, replacing revenge, maiming, and
castration. The isolation theory found favor in keeping the convict away from society (and the victim).
