Answer: The phrase originated with the Magna Carta in England to distinguish noblemen from commoners.
Modernly, it has been defined as a jury of ones equals. Further, some state that the phrase means a jury
made up of a cross-section of the community. Keep in mind that the word peers does not appear in the
Constitution.
