Answer to Question 1

Answer: First, the defendant must show that counsels performance was deficient. Second, the defendant must
show that counsels deficient performance prejudiced the defense. Strickland v. Washington (1984), 466
U.S. 668 covers the point.

Answer to Question 2

Answer: It clarifies when the right to counsel begins. It points out the right to counsel during any police
investigation.
