Answer to Question 2

Answer: Good answers should focus on the purpose of the AEDPA, its new crimes and criminal procedures, and the limitations it put on federal habeas corpus for all cases. The act provided for mandatory victim restitution, eased deportation requirements, and set a low compensation rate for court-appointed attorneys and defense investigation fees. Regarding habeas corpus, it severely restricts habeas relief in death penalty cases and curbs multiple writ petitions. Students should take a position on whether the restrictions are appropriate or too big of an infringement on tradition criminal procedure and habeas protections.
