Answer to Question 1

Answer: Answers will discuss the term witness and define how the Fifth Amendment protects against self-incrimination. According to the Supreme Court, The Constitution explicitly prohibits compelling an accused to bear witness against himself;' it necessarily does not proscribe incriminating statements elicited from another.

Answer to Question 2

Answer: Good answer will address the holding and purpose of the Miranda decision. Then students should take a position and support it in light of the court's reasoning.
