Question 2

Was Stratton's Fifth Amendment right against self-incrimination violated when the jury was shown a video with him refusing to identify himself to Officer Chavez during a Terry stop?

A party of about 20 people, including Hispanics and African Americans, turned violent when a fight erupted and two black men were evicted. They returned shortly with Torrence Stratton, who was described as wearing a bright shirt. They brandished guns, were forced out, but returned immediately and fired shots, striking several party-goers. Pasco Police Officer Chavez, patrolling in an audio/video equipped car, was notified by dispatch about the shooting. He spotted and followed a vehicle matching the dispatch description, and pulled in behind the suspect vehicle when it parked on a side street. He saw a black male dressed in a yellow shirt walking away; he was Torrance Stratton. Officer Chavez testified that Stratton didn't want to talk to me. Defense counsel objected; the court sustained the objection and instructed the jury to disregard that testimony. However, a video of Officer Chavez stopping Stratton was played to the jury. The man identified as Stratton did not clearly respond when asked his name three times.

Though Candida and Aspergillus species are the most common fungal pathogens causing invasive fungal disease in the immunocompromised, infections due to previously uncommon hyaline and dematiaceous filamentous fungi are occurring more often today. Rare fungal infections, once accurately diagnosed, may require surgical debridement, immunotherapy, and newer antifungals used singly or in combination with older antifungals, on a case-by-case basis.

Dogs have been used in studies to detect various cancers in human subjects. They have been trained to sniff breath samples from humans that were collected by having them breathe into special tubes. These people included 55 lung cancer patients, 31 breast cancer patients, and 83 cancer-free patients. The dogs detected 54 of the 55 lung cancer patients as having cancer, detected 28 of the 31 breast cancer patients, and gave only three false-positive results (detecting cancer in people who didn't have it).
