Most indigent defense attorneys are paid by the state, although some states require the defendant to pay a portion or prorated fee. Indigent attorneys might have higher caseloads.

Research has found no significant difference between the two types of attorneys in terms of guilty pleas, trial verdicts, and case dismissals.
