Documentary evidence encompass a range of communications and can include: video or audio recordings, digital media, printed e-mails, transcripts, and personal writings. Evidence can be incriminating statements, proof of fraudulence, or dated and time-stamped receipts. This type of evidence still needs to follow the chain of custody and be authenticated. Some forms of documentary evidence may also be considered real evidence. The parol evidence rule hinges upon the assumption that a written agreement or contract is the final expression of that agreement and may not be modified, contradicted, or otherwise considered by outside statements whether oral or written. The best evidence rule provides that secondary evidence, such as copies or facsimiles, are not admissible when the original is available.
