The Framers of the U.S. Constitution adopted much of the legal rationale from English common law and recognized the importance of privileged communications. The courts have defined such privileges narrowly and expressed reluctance to expand their boundaries. State governments were the first to recognize that relationships grounded in socially valued intimacies, must be protected against governmental invasion. Statues emerged at the same time as compulsory witness testimony. In 1972 the Federal Rules of Evidence originally drafted to nine distinct privileges. Congress rejected the federal privileges, and privileged communications varies across jurisdictions and no absolute standard exists for their admission.
