There are lay witnesses who possess firsthand knowledge of a fact at issue in the case, and expert witnesses who possess specialized knowledge of a fact at issue in the case. Generally speaking, lay witnesses are limited to those things that are observed by one of their five senses, whereas expert witness may provide opinion and answer hypothetical questions. Expert witnesses are employed to assist jurors in understanding complex issues outside of the boundaries of common knowledge. Lay witnesses may present facts and opinions. Judges determine whether the proposed individual possesses the adequate qualifications and whether expert testimony exists and will be meaningful. Expert witnesses may be used in high-profile cases and may be paid for their testimony.
