Aside from mistrials, as discussed above, retrials resulting from successful postconviction appeals are permissible because the original judgement is invalidated upon reversal. Another exception is the separate sovereigns' exception where prosecution for the same criminal act can be tried in both state and federal courts of that jurisdiction where the offense took place. Double jeopardy also does not attach in cases in which different standards of proof apply like criminal court verses civil court. Examples will vary.
