Answer to Question 1

b

Answer to Question 2

The definition of probable cause is not something that is quantitative and is constantly being evaluated by the court to define and specify the definition. Probable cause exists where the facts and circumstances within their (the officers') knowledge and of which they had reasonably trustworthy information (are) sufficient in themselves to warrant a man of reasonable caution in the belief that an offense has been or is being committed. The Brinegar v. United States continued the clarification of the standard of probable cause. The Court stated in this case that probabilities are not technical, they are the factual and practical considerations of everyday life on which reasonable and prudent men act.
