The issue of state sovereignty, alien to most cultures, is fundamental to the American system of criminal justice. Each state is sovereignhaving its own constitution, criminal code, and rules of procedure. Such sovereignty is limited only by provisions of the U.S. Constitution that directly apply to the states. Although states may not abridge the rights guaranteed under the Constitution and the Bill of Rights, they may enhance or further protect those liberties at their discretion. Thus, with the exception of constitutional mainstays, states remain independent in their interpretation of evidentiary rules. This often results in inconsistency across state lines
