Nevertheless, courts routinely permit in-court identifications. But if an in-court identification is tainted by an out-of-court identification, it may be excluded. This is known as a tainted identification. Unfortunately, it is not always easy to decide whether an in-court identification is fruit of the poisonous tree. In United States v. Wade, the Supreme Court held that an illegally conducted lineup does not invalidate later identifications resulting from an independent source.
