After an indictment has been filed, the Sixth Amendment right to counsel applies to the witness identification process. In United States v. Wade, 388 U.S. 218 (1967), a defendant was placed in a police lineup, without his attorney present, after he had been indicted for a crime. The Supreme Court held that this violated the Sixth Amendment because a post-indictment lineup is a critical stage in the criminal process. Further, the presence of counsel at post-indictment lineups is necessary to preserve the defendant's basic right to a fair trial.
