What is the basic premise of the
consent exception?
◦ As long as any one party involved in a communications link is aware of and consents to the interception of the communication, other parties need not be informed.
◦ All parties involved in the recording of a conversation must be given the opportunity to grant or deny consent to the making of such a recording.
◦ The monitoring of an employee's computer system at work is allowed because, by accepting the terms of employment, they have essentially give the company implied consent.
◦ Because the suspect of a crime is not informed that a recording is being made, and since no warrant was issued, they are determined to have not given consent to such a recording.
