A situation similar to O'Connor versus Donaldson (1975 ) is unlikely to ever occur in Canada because:
 
  a) The ethical code has more stringent guidelines on informed consent and confidentiality
  b) A patient has a right to refuse treatment and a prior capable wish
  c) Mental patients can only be detained against their will for a maximum of 10 years
