Yes. Each distribution center is a separate establishment under the EPA. Each distribution center is a distinct, physical place, rather than the entire Nash Finch business as the establishment, as the plaintiff asserts. The effect is that Crosier and Ebensteiner are not proper comparators since they did not work in the same establishment..
