Answer to Question 1

The defendant was the president of the Uniformed Sanitationmen's Association. After prolonged negotiations for a new collective bargaining agreement with the city of New York, the union went out on strike. DeLury urged the members to strike and refused to obey a court injunction prohibiting the strike. The strike lasted for nine days.
