Answer to Question 1

Section 301 of the National Labor Relations Act (NLRA) provides that suits for violations of contracts between an employer and a labor union may be brought in federal and state courts. Therefore, either the union or employer could bring a lawsuit over the other side's failure to live up to the contract.
