Answer to Question 1

D

Answer to Question 2

Students should discuss the following:
1. Purpose of such zoning

2. Whether a general welfare purpose is served

3. Whether religious exercise is prohibited or simply controlled

In Lakewood Ohio Congregation of Jehovah's Witnesses v. City of Lakewood, 51 L.W. 2499 (CA 6 1983), the court upheld the zoning ordinance on the basis of congestion, noise, etc. caused by church services.
