Answer to Question 1

Should those rights
be the same as or different from regular soldiers from an enemy force? Should those
rights be the same as or different from ordinary criminals captured by a government?
Explain your conclusions.



Answer to Question 2

How would David Luban critique that justification? Would you agree with Dershowitz or
Luban? Explain why.
