The EEOC has three functions: processing discriminating complaints, issuing written regulations, and information gathering and dissemination. The EEOC attempts to resolve cases by conciliation. It cannot compel an employer to pay compensation or damages, but it may issue a right-to-sue letter to the complainant if conciliation does not resolve the case. The (OFCCP) only regulates the EEO laws in companies that are run or contracted by the federal government. Unlike the EEOC, it is proactive in monitoring compliance with the regulations and it can also mete out financial consequences for non-compliance.
