An ideal response will:
1, Note that John must first appeal his conviction to the intermediate appellate court.
2, Explain that either John or the government could ask the Supreme Court to review the decision of the circuit court by filing a petition for a writ of certiorari.
3, Recognize that the case will only be heard and decided by the Supreme Court if at least four justices agree to hear the case.
