Johnson, that the 1906 Food and Drug Act did not prohibit false therapeutic claims, but only false and misleading statements about the ingredients or identity of a drug. In 1912, Congress went further and en-acted the Sherley Amendment to prohibit drug labels containing false therapeutic claims intend-ed to defraud the purchaser.
