Answer to Question 1

If vague terms are included in specifications they could cause contractors to misinterpret their intent and lead to issues between owners and contractors that might result in contractors having to redo some items of work at either their own expense or at the expense of the owner. A protracted discussion would be required to determine the meaning of these types of terms unless the engineer who wrote the specification is available to explain the intention of a term.

Answer to Question 2

Performance bonds protect owners in the event that the contractor building their project breaches the contract. If the contractor breaches the contract the surety company will complete the project by either helping the existing contractor finish the project, rebidding the project, or finishing the project using a cost plus contractor.
